Operating a Motor Vehicle without a Driver’s License - 625 ILCS 5/6-101

  • This offense applies when you drive a motor vehicle on a public roadway without possession of a valid drivers license or permit. 

  • The prosecutor will use records from the Secretary of State to prove that you did not have a license at the time of the offense. 

  • Similar to driving without insurance, if we can prove you did have a driver’s license, even if it was acquired after the stop, we can enter negotiations with the prosecutor for a reduced sentence. Showing the court you are taking a proactive effort towards compliance is powerful mitigation that can lead to a more favorable outcome.

Operating a Motor Vehicle Without Insurance - 625 ILCS 5/3-707

  • This statute makes it illegal to operate a motor vehicle in Illinois unless it is covered by the mandatory minimum liability insurance. If you are unable to produce proof of insurance at the time you were pulled over, you will be deemed to be operating an uninsured vehicle under the law. 

  • The prosecutor relies on the fact that you failed to display proof of insurance when requested by law enforcement officers in connection to observation of your actual physical control of a motor vehicle. Notably, not displaying proof of insurance is enough to support the charge even if you had coverage.

  • We scrutinize the reason for the initial stop, if the stop was unlawful then any subsequent request for proof of insurance and the resulting ticket may be suppressed. 

  • If we can prove you have insurance, even if it was acquired after the stop, we will enter negotiations with the prosecutor for a reduced sentence. Non-Owner Car Insurance - SR-22

    • Non-owner car insurance is personal liability insurance for a driver who does not own the vehicle they are driving. Non-owner car insurance is a bare minimum insurance policy that technically meets the legal minimum coverage required in the State of Illinois to drive a vehicle. This option is offered at reduced price due to the policy coverage limitations. Notably, these policies do not insure the vehicle the policy holder is driving, rather they provide a liability shield to other drivers when a collision occurs.

    • In Illinois, a driver must have insurance to operate a motor vehicle. Non-owner car insurance satisfies this threshold at a discount rate, although the scope of policy is extremely limited.

    • SR-22 is an insurance issued proof of policy form which can be used in court to satisfy the requirement of minimum insurance coverage to drive. Getting SR-22, even after the issuance of citations, may be used as mitigation relating to traffic violations without insurance.
